1. Acceptance of Terms

By accessing or using the ShiftsGo platform (“Service”), you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

ShiftsGo provides a cloud-based platform for:

  • Security shift management
  • Workforce scheduling and attendance workflows
  • Operational reporting, task coordination, and field visibility
  • Incident reporting and activity tracking

3. Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining account confidentiality and security
  • You are responsible for activity that occurs under your accounts and credentials

4. Use Restrictions

You agree not to:

  • Violate applicable laws or regulations
  • Attempt unauthorized access to systems, data, or accounts
  • Reverse engineer, copy, or misuse the platform except as permitted by law
  • Upload or misuse operational records, evidence, or other customer data in a manner that violates law or third-party rights

5. Subscription and Payments

  • Services may be billed monthly or annually
  • Fees are non-refundable unless expressly stated otherwise
  • Late or failed payments may result in suspension or restricted access

6. Customer Data and Privacy

  • You retain ownership of data you upload to the Service
  • ShiftsGo may process that data as necessary to operate, secure, and support the Service
  • You are responsible for ensuring you have the appropriate rights, notices, and permissions for data submitted through the platform
  • Use of the Service is also governed by our Privacy Policy

7. Service Availability

We aim for high availability, but we do not guarantee uninterrupted or error-free service.

8. Intellectual Property

  • All platform intellectual property belongs to ShiftsGo Inc.
  • Users retain ownership of their uploaded data and content

9. Termination

We may suspend or terminate access if:

  • These Terms are violated
  • Payments are not made when due
  • There is misuse of the system or abuse of the Service

10. Limitation of Liability

To the maximum extent permitted by law:

  • ShiftsGo is not liable for indirect, incidental, special, or consequential damages
  • Total liability is limited to fees paid for the Service in the 3 months preceding the claim

11. Indemnification

You agree to indemnify and hold ShiftsGo harmless against claims arising from:

  • Your misuse of the platform
  • Your violation of law or third-party rights

12. Governing Law

These Terms are governed by the laws of Canada, subject to additional local compliance requirements that may apply based on customer location.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after an update becomes effective constitutes acceptance of the revised Terms.
